Welcome to Stone & Form. These Terms & Conditions ("Terms") govern your use of our website (www.stoneandform.com.au) and the purchase of any products from us.

This website is owned and operated by The Trustee for DE BTL Unit Trust (ABN: 83063564866) ("we", "us", "our"). Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.
2. The Nature of Our Products
Acknowledgement of Natural Variation: Our products are handcrafted from natural marble. Marble is a natural material, and as such, it contains variations in colour, veining, pattern, and texture. These are not defects but are inherent characteristics of the stone that make each piece unique.
By purchasing a product from Stone & Form, you acknowledge and agree that:
• The product you receive will vary from the product images on our website. No two basins are identical.
• Natural variations such as veining, mineral deposits, pits, and colour differences are expected and are not considered defects or faults.
• These variations are not grounds for a return, refund, or claim under warranty.
We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your computer monitor's display of any colour will be accurate.
3. Pricing and Payment
All prices are listed in Australian Dollars (AUD) and are inclusive of any applicable Goods and Services Tax (GST).
We reserve the right to change our prices at any time without notice. Payment must be made in full at the time of purchase through the payment methods provided on our website.
4. Shipping and Delivery
Please refer to our separate Shipping & Returns Policy for detailed information on shipping processes, costs, and timeframes.
Risk and title in the products pass to you upon delivery. It is your responsibility to inspect the goods upon delivery. Any damage in transit must be reported to us within 48 hours of receipt, accompanied by photographic evidence.
5. Returns, Refunds, and Exchanges
In accordance with Australian Consumer Law, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
A "major failure" includes goods that:
• Arrive broken, cracked, or significantly damaged (unrelated to natural stone features).
• Are substantially different from the product description (e.g., you ordered an oval basin and received a donut-shaped one).
We do not offer refunds or exchanges for:
• Change of mind.
• Natural variations in the stone (as detailed in Section 2).
• Damage caused after delivery (e.g., during installation or use).

6. Limitation of Liability
To the maximum extent permitted by law, Stone & Form shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:
• Your use of our products.
• Any damage caused during or after installation.
• Your access to or use of or inability to access or use our website.
Our liability for any claim relating to the products shall not exceed the purchase price of the products.
7. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Stone & Form or its content suppliers and is protected by Australian and international copyright laws.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
